GENDER-BASED VIOLENCE AND STRUCTURAL REVICTIMIZATION: THE GLASS LABYRINTH WITHIN THE JUSTICE SYSTEM.
Gender-based violence constitutes a social scourge throughout Latin America. According to the Bulletin of the ECLAC Gender Equality Observatory (2025), it is estimated that at least 3,770 women were victims of femicide, feminicide, or violent death for reasons of gender in 26 countries and territories of the region, averaging 11 violent deaths of women for reasons of gender each day, with a cumulative total of 19,237 femicides recorded in the region over the past five years. In addition, state institutions have developed practices that subject female victims to a second victimization (revictimization). Through negligence, gender stereotypes, inhumane procedural timelines, and judicial bias, women end up abandoning their pursuit of justice. The objective of this symposium is to analyze revictimization and gender-based institutional violence. Topics addressed will include the patriarchal design of the judicial system, legal familism, epistemic injustice, and risk factors and intersectionality. Finally, some possible solutions will be proposed, including the need for structural reforms, the requirement of a gender perspective in justice, and the need to move from violence to institutional care.
