Climate change occupies a privileged place on the global agenda, but within environmental rhetoric it remains dispensable, superfluous, or tragically ephemeral; while the world of military and economic powers competes for geopolitical dominance, Kant’s “imperfect peace” reminds us of the question of peace with nature. At the heart of this America lies the Amazonian biome, spanning nine countries; a true climate regulator home to more than 400 indigenous peoples who contribute their diversity and cosmovision as witnesses resisting dominant Western models.

Following the Final Agreement for the Termination of the Conflict signed with one of the continent’s historic guerrilla groups, the Special Jurisdiction for Peace (JEP) was born in 2016, and with it, a judicial response to a paradigm shift begun in Colombia with Constitutional Court ruling T-622 of 2016 and Supreme Court of Justice ruling STC-4360 of 2018. The laboratory emerging from these institutions makes it possible to recognize the conflicts and perspectives involved in granting legal status to non-human entities. Indeed, nature was recognized as a victim of the Colombian armed conflict, establishing a milestone that displaced the human being as the exclusive subject of reparation. This ecocentric turn challenges the State, academia and communities, demanding new legal, political, aesthetic, technical, theological and philosophical grammars to heal territories devastated by war, illicit economies, the silencing of the voices of indigenous, Afro-descendant and peasant peoples, and the rupture of environmental balance as a consequence of the expansion of economic activities in ecosystemically fragile territories.

This Symposium proposes a space for interdisciplinary dialogue to examine how the Amazon, and with it the judicial recognition of legal status, raises a turning point in the debate over economic and environmental constitutionalism on the continent. New Andean constitutionalism, and in particular the precedent derived from Colombia’s 2016 Final Agreement, engages, tensions and enriches the Latin American legal tradition of the rights of nature, inaugurated by Ecuador (2008) and Bolivia (2010). From this perspective, the JEP experience constitutes a unique laboratory of ecological restorative justice whose lessons deserve study and scrutiny by the academic community.

The symposium calls for inter- and transdisciplinary papers organized around four articulating axes: 1. Epistemic foundations of the ecocentric turn. 2. Comparative legal frameworks; 3. Territorial governance and public policy; 4. Technical and socio-ecological dimensions.

The proposal seeks to recover legal, philosophical and community traditions of the continent regarding the human-nature bond and put them into dialogue with contemporary institutional innovations such as ecocentric justice, climate litigation, the rights of nature, and socio-territorial tensions. Beyond the Colombian case, it seeks to contribute to the Americanist debate on how to build a stable, lasting and ecologically just peace for the peoples and territories of the Americas.

[52
post-10490","simposio","type-simposio","status-publish","hentry","simposio_area-derecho-y-derechos-humanos

ECOCENTRIC PEACE IN THE AMERICAS: RIGHTS OF NATURE AND TRANSITIONAL JUSTICE INSPIRED BY THE MODEL DERIVED FROM THE COLOMBIAN POST-CONFLICT. - 59º Congreso Internacional de Americanistas

<meta property="og:description" content="America stands as a catalyst confronting unresolved questions of a planet in transition.
