Postmodern societies, forged in the globalization of productive processes and the transnational nature of commercial interactions, face growing difficulties in preventing, investigating and repressing conflicts. In an era of technofeudalism, we observe the existence of multinational corporations that, beyond shaping the global economy, hold factual power greater than that of the countries in which they operate, in many situations overriding democratically elected political powers. Beyond these, other companies have such economic weight that they become “too big to jail,” hindering or even preventing due state legal action. As a consequence, state action in protecting fundamental rights and guarantees within the corporate sphere faces limits and challenges, especially given the impossibility of responding efficiently and swiftly to infractions committed within and by companies. It is not without reason that mechanisms of (self-)regulation delegated to private actors\u2014such as Compliance\u2014have come to occupy significant space in sustaining democratic structures, not only in their more traditional facet of implementing normative compliance programs (developing policies and codes), but also encompassing broader instruments such as risk assessment and management, due diligence, and, more recently, action focused on ecological, social and governance sustainability (ESG) aimed at realizing the United Nations 2030 Agenda and its Sustainable Development Goals (SDGs), which are interconnected with the sustainability triptych. Given this scenario, this Symposium is intended to discuss topics related to corporate conduct in compliance with legally established human rights parameters, addressing issues related to compliance\/integrity\/regulatory adherence and its correlation with the realization of fundamental guarantees across various fields. Starting from topics linked to corporate social responsibility and more democratic governance models, the research should present how these programs must comply with labor, tax, criminal, anti-discrimination and gender-equality standards, data privacy regulations, the use of new technologies, environmental protection, among others. In methodological terms, the working group should be guided by analytical proposals grounded in a review\/update of the state of the art on these topics, and\/or the discussion of practical cases and accounts of corporate experiences that advance perspectives for conflict resolution and prevention, with a view that takes into account the specificities of the American context. As a result of the exchange of ideas fostered by the group, it is hoped that participants will deepen their academic and professional research and disseminate good practices in their countries of origin, providing a space in which the exchange of experiences results in strategies for developing new democratic proposals for corporate governance.<\/p>\n","protected":false},"template":"","simposio_area":[52],"class_list":["post-10488","simposio","type-simposio","status-publish","hentry","simposio_area-derecho-y-derechos-humanos"],"yoast_head":"\n
