This symposium proposes a critical and empirically oriented analysis of the effects produced by the doctrine of the Unconstitutional State of Affairs (ECI) in Brazil and Colombia. Originating in the jurisprudence of the Colombian Constitutional Court as a response to massive, widespread and persistent violations of fundamental rights, the ECI doctrine has established itself as one of the most significant Latin American experiences of structural litigation and judicial protection of human rights. Its reception in the Brazilian context, especially following ADPF 347, has sparked new debates about the role of constitutional courts in the face of structural failures of the State and the incapacity of public authorities to guarantee fundamental rights to vulnerabilized groups.<\/p>\n
Although legal scholarship has extensively addressed the theoretical foundations, democratic legitimacy and institutional challenges of structural decisions, studies aimed at measuring their concrete results remain relatively scarce. In this sense, the symposium seeks to shift the focus of debate away from a purely normative perspective toward an evidence-based approach, bringing together research that examines, through quantitative and qualitative data, the effectiveness of structural decisions in transforming realities marked by systematic human rights violations.<\/p>\n
The prison system constitutes the main field of observation for this proposal, given the existing dialogue between the Colombian precedents and ADPF 347 in Brazil. However, studies on other situations recognized or discussed under the ECI framework will be equally welcome, including forced displacement, the protection of indigenous peoples and traditional communities, social rights, the climate emergency, access to health, housing policies, and other forms of structural vulnerability.<\/p>\n
Contributions analyzing impact indicators, budget execution, public policy implementation, institutional monitoring, and mechanisms for overseeing compliance with judicial decisions will be especially encouraged. Works exploring innovative methodologies for empirical evaluation, as well as comparative research involving different Latin American countries and other experiences of structural litigation in the global context, will also be welcome.<\/p>\n
By fostering dialogue among researchers in Law, Political Science, Sociology, Public Administration, Human Rights and related fields, the symposium aims to contribute to a broader understanding of the limits and potential of the Unconstitutional State of Affairs as an instrument of institutional transformation. The proposal seeks to foster critical reflection on the capacity of structural decisions to produce verifiable changes in the living conditions of affected populations, strengthening the debate on the effectiveness of human rights, democratic governance and social justice in the Americas.<\/p>\n
