Criminal Law, Garantism and the Effectiveness of Criminal Justice. Modern Criminal Law lives in permanent tension between two values: the guarantee of individual liberties and effectiveness in protecting society against crime. This tension manifests itself in the debate between criminal garantism and the efficiency of the criminal system.
\n1. Criminal Garantism as a Limit on Punitive Power
\nGarantism, theorized by Luigi Ferrajoli, starts from the premise that Criminal Law is only legitimate if it functions as a system of limits on state power. Without procedural guarantees, the State becomes a source of arbitrariness. Its pillars are: strict legality, presumption of innocence, adversarial proceedings, full defense, due process of law, and proportionality of punishment. The garantist criminal process does not seek conviction at any cost. It seeks procedural truth within strict rules that protect the individual against the excessive power of the State.
\nIn practice, this means that evidence obtained by illicit means must be excluded, even if it proves guilt. It also means that pretrial detention is justified only in exceptional cases, not as an anticipation of punishment.
\n2. The Demand for Effectiveness
\nOn the other side is the social demand for effectiveness. The perception of impunity grows when serious crimes do not result in a swift or proportionate state response. Procedural delays, prison overcrowding, and low clearance rates for violent crimes erode confidence in the system.
\nEffectiveness is not merely about making more arrests. It involves procedural speed, adequate penal enforcement, crime prevention, and reparation for the victim. A system that takes ten years to try a homicide case is not effective, even if a conviction is ultimately obtained.
\n3. The False Dilemma: Guarantees vs. Efficiency
\nThe common mistake is to treat garantism and effectiveness as opposites. Procedural guarantees are not obstacles; they are conditions of validity for justice itself. A process that disregards guarantees produces an illegitimate conviction, which does not pacify the social conflict.
\nReal effectiveness comes from a system that investigates well, adjudicates within a reasonable time, and enforces punishment in a way that promotes rehabilitation. This requires investment in forensic police work, a well-structured Public Prosecutor’s Office, a strengthened Public Defender’s Office, and an independent judiciary\u2014not the relaxation of fundamental rights.
\n4. Balance in Practice
\nThe point of balance lies in proportional application. In lesser offenses, decriminalizing measures and restorative justice increase effectiveness without sacrificing guarantees. In serious crimes, rigor in investigation and enforcement must be accompanied by respect for due process.
\nGarantism does not protect the criminal. It protects the citizen against the risk of being treated as a criminal without due evidence. And effectiveness does not mean punitivism.
